    Sitterly is a Marketplace

Sitterly Pty Ltd operates as a marketplace platform that connects pet owners with independent sitters. We do not employ sitters, supervise sits, or control how sitters provide their services. Sitterly is not a party to any agreement formed between a sitter and a pet owner.

As an independent user of this platform, you are solely responsible for:

·Determining your own availability and which bookings to accept or decline
·Setting your own rates and the scope of services you offer
·Any financial, legal, or insurance obligations that may apply to your activities
·Complying with all laws applicable to you in your state or territory

Sitterly does not withhold any amounts from sitters, does not process payments between users, and does not provide superannuation contributions or workers' compensation coverage.

Eligibility to Register as a Sitter

Sitterly is an open marketplace. To register and maintain an active sitter profile, you must:

Be at least 18 years of age
Provide accurate and truthful information in your profile
Have a valid email address and be contactable by pet owners through the platform
Not have been previously banned or removed from the Sitterly platform

Sitterly does not verify work rights, ABN status, or tax registration. You are responsible for ensuring that your own activities comply with any obligations that apply to you personally.

    3

    Your Profile and Representation

Your profile is how pet owners find and assess you. You must ensure it is accurate at all times.

·Only claim experience, qualifications, or certifications you genuinely hold
·Do not describe yourself as "police checked", "insured", "certified", or "verified" unless you can substantiate these claims with current documentation
·Use real, recent photos of yourself
·Keep your availability calendar up to date
·Update your profile promptly if any material information changes

Sitterly reserves the right to remove or edit profile content that is misleading, inaccurate, or in breach of Australian Consumer Law.

    4

    Accepting and Fulfilling Bookings

·You are under no obligation to accept any booking request
·Once you accept a booking, you are committed to fulfilling it as agreed with the pet owner. Late cancellations cause significant disruption and may result in a warning or suspension
·If you need to cancel an accepted booking, notify the pet owner as early as possible and contact Sitterly support at support@sitterly.com.au
·You must provide the level of care described in your profile and agreed with the pet owner
·You must follow all care instructions provided by the pet owner, including feeding schedules, medication requirements, and emergency contact details
    5

    Pet and Property Safety

·You must take all reasonable steps to ensure the safety and welfare of any pet in your care
·In the event of a pet health emergency, you must contact the pet owner immediately and seek veterinary treatment without delay - do not wait for owner authorisation before seeking emergency care if the pet's life is at risk
·You are responsible for any damage caused to a pet owner's property through your negligence or misconduct during a booking
·For home minding arrangements, you must treat the property with reasonable care, not remove items from the property, and leave it in the same condition as when you arrived
·You must not allow unauthorised persons to enter the property without the pet owner's prior written consent
    6

    Insurance

Sitterly does not provide public liability insurance, professional indemnity insurance, or any other insurance coverage to sitters. You are strongly encouraged to obtain your own public liability insurance before accepting bookings. Sitterly accepts no liability for any incident, claim, or loss arising during a booking, whether or not you hold insurance.

If a pet owner asks whether you are insured, you must answer honestly. Do not claim to be insured if you are not.

    7

    Subscription Fee and Payments

Access to the Sitterly platform as a sitter requires payment of a subscription fee — $9.95 AUD/month or $72.99 AUD/year — processed via Stripe. Your subscription renews automatically unless cancelled through your account settings before the renewal date.

Financial arrangements for individual bookings — including your rates, deposits, and cancellation terms — are agreed directly between you and the pet owner. Sitterly is not a party to these arrangements and does not take any commission or percentage of booking fees.

All payments between sitters and pet owners must be arranged honestly and transparently. Sitterly is not responsible for any payment disputes between users.

    8

    Confidentiality

In the course of providing services, you may have access to personal information about pet owners, their pets, and their homes. You must:

·Keep all such information strictly confidential
·Not share, disclose, or use it for any purpose other than providing the agreed service
·Not photograph, film, or record a client's home or personal belongings without explicit consent
·Comply with the Australian Privacy Principles in respect of any personal information you handle in connection with your services
    9

    Conduct and Suspension

In addition to our Community Guidelines, the following conduct will result in immediate suspension or permanent removal from the platform without refund of any remaining subscription period:

Abandoning a pet or home midway through a confirmed booking without cause
Causing deliberate harm or neglect to a pet
Theft or misappropriation of a client's property
Providing false emergency or identity information
Repeated late cancellations of confirmed bookings
Any conduct that brings Sitterly into disrepute
    10

    Termination of This Agreement

Either party may terminate this Agreement at any time. You may terminate by cancelling your sitter subscription and deactivating your profile through your account settings. Sitterly may terminate this Agreement and remove your access to the platform at any time for breach of this Agreement, the Terms of Service, or the Community Guidelines, with or without notice.

Termination does not affect any accrued rights or obligations, including any outstanding confirmed bookings at the time of termination.

    11

    Governing Law

This Agreement is governed by the laws of the State of Victoria, Australia. Any dispute arising from this Agreement that cannot be resolved through good faith negotiation within 30 days shall be subject to the exclusive jurisdiction of the courts of Victoria.
