Acceptance of Terms
By accessing and using the Sitterly platform ("the Platform"), operated by Sitterly Pty Ltd (ABN 50 696 419 404) ("Sitterly", "we", "us", or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Platform.
These Terms of Service are governed by the laws of the State of Victoria, Australia.
Platform Purpose and Services
Sitterly provides an online marketplace that connects pet sitters with pet owners and homeowners seeking pet care services. We facilitate introductions and communications between users but do not provide pet sitting or home minding services directly. Sitterly is a platform intermediary only.
Our services include profile creation, listing management, messaging tools, and user reviews. The Platform is free for pet owners/homeowners. Pet sitters are required to pay a subscription fee - $9.95 AUD/month or $72.99 AUD/year (inclusive of any applicable taxes) - to maintain an active profile.
Limitation of Liability and Disclaimer
IMPORTANT - PLEASE READ THIS SECTION CAREFULLY.
Sitterly is a platform service only. We provide a means for pet sitters and pet owners/homeowners to connect and communicate with each other. We are not a party to any agreements made between users and do not employ, recommend, or endorse any specific pet sitter or homeowner.
3.1 No Liability for User Interactions
To the maximum extent permitted by Australian law, Sitterly is not responsible or liable for any incidents, damages, losses, injuries, disputes, or claims that arise from interactions between users, including but not limited to:
- Injury to or death of pets under a sitter's care
- Damage to property or belongings
- Theft, loss, or misuse of property
- Personal injury to pet sitters or homeowners
- Breach of agreements between users
- Quality or standard of pet sitting services provided
- Accuracy of information provided by users
3.2 User Responsibility
All arrangements, agreements, and interactions between pet sitters and pet owners/homeowners are the sole responsibility of the parties involved. Users are responsible for conducting their own due diligence, verifying credentials, obtaining appropriate insurance, and taking necessary precautions.
3.3 Indemnification
By using the Platform, you agree to indemnify and hold harmless Sitterly Pty Ltd (ABN 50 696 419 404), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform or your interactions with other users.
3.4 Australian Consumer Law
Nothing in these Terms of Service excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) which cannot lawfully be excluded or limited. Where such statutory guarantees apply, Sitterly's liability is limited to the maximum extent permitted by law.
User Responsibilities
4.1 Pet Owners / Homeowners
- Providing accurate information about their pets, home, and requirements
- Conducting thorough screening of potential pet sitters
- Meeting sitters in person or via video call before confirming arrangements
- Verifying the sitter's experience, references, and suitability
- Providing clear emergency contact information and veterinary instructions
- Ensuring their pets are properly vaccinated and in good health
- Maintaining appropriate home and pet insurance coverage
4.2 Pet Sitters
- Providing accurate information about their experience and capabilities
- Only accepting assignments they are qualified and capable of handling
- Providing the standard of care agreed upon with pet owners
- Following all instructions provided by pet owners
- Maintaining appropriate insurance coverage for their activities
- Promptly communicating any issues, incidents, or emergencies to pet owners
Account Registration and Security
Users must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to create an account.
You must notify us immediately of any unauthorised use of your account or any other security breach by contacting support@sitterly.com.au.

6.3 Refunds
Subscription fees are non-refundable except as required by the Australian Consumer Law. Users may cancel their subscription at any time through their account settings, and access will continue until the end of the paid subscription period. Nothing in this clause limits your rights under the Australian Consumer Law.

Unverified Profiles
Sitterly does not conduct background checks, police checks, identity verification, or reference checks on users unless expressly stated. Users are solely responsible for verifying the credentials of any pet sitter or homeowner they engage through the Platform. Sitterly makes no representations about the trustworthiness, qualifications, or suitability of any user.
Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of Sitterly Pty Ltd or its licensors and is protected by Australian intellectual property laws. Users may not reproduce, distribute, or create derivative works without our express written permission.
By uploading content (including profile photos, pet photos, and reviews) to the Platform, you grant Sitterly a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purposes of operating and promoting the Platform.
Privacy
Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms of Service. By using Sitterly, you consent to the collection and use of your personal information as described in the Privacy Policy, including disclosure to overseas service providers as outlined therein.
Termination
We reserve the right to suspend or terminate user accounts at our discretion, with or without notice, for violations of these Terms of Service, fraudulent conduct, or for any other reason we deem appropriate. Users may also terminate their accounts at any time through their account settings. No refund of any remaining subscription period will be provided upon voluntary termination.
Modifications to Terms
Sitterly reserves the right to modify these Terms of Service at any time. We will notify users of significant changes via email or Platform notification at least 14 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the modified terms.
Dispute Resolution
13.1 Between Users
Sitterly is not responsible for resolving disputes between pet sitters and pet owners/homeowners. Users are encouraged to resolve disputes directly and in good faith.
13.2 With Sitterly
Any dispute arising from or relating to these Terms of Service or use of the Platform shall first be attempted to be resolved through good faith negotiations. If a dispute cannot be resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts of the State of Victoria, Australia, and governed by Victorian and Australian law.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
